【PDCA日記 Vol. 770「トラブルの種類は大別すると3つ」】
過去のPDCA日記でも紹介しましたが、私は銀行員時代に当局対応の仕事をしていました。
当局対応とは行政機関相手の窓口業務であり、役所の担当者と色々な交渉を行う仕事に携わっていました。
銀行や証券会社などの場合、当局から免許を取ったり、登録を行わなければ営業することができません。
言い換えると金融業は規制ビジネスであり、当局との円滑なコミュニケーションが必要になってきます。
銀行が法令違反などをしてしまうと、当局は銀行法に基づいて検査を実施し、重大な問題が発覚した場合には業務改善命令などの行政処分を下します。
行政処分に不服がある場合、銀行は不服審査手続きを行う権利がありますが、実際に手続きに進むケースは殆どありません。
今回紹介する資料「示談・調停・和解のやり方がわかる」は「早く・安く・しこりなく解決したい人に」をキャッチフレーズにしており、「トラブルの種類は大別すれば3つ」部分の以下フレーズが印象的でした。
「一口に事件と言っても、その種類は両手両足の指を使っても数えきれないほど多くの種類があります。
大きく分けると、金を盗まれた、ケガを負わされたなどの刑事事件、税金の課税額に不服など国や行政機関が相手の行政事件、それ以外の民事事件となります。
刑事事件であれば、警察に通報する、または告訴するなどの手続きをとれば、後は警察が犯人を逮捕し、検察官が刑事裁判を起こして、犯人が処罰されることになります。
ただし、事件に伴う損害賠償請求は自分でしなければなりません。
行政事件であれば、行政処分をした行政機関に対して行政不服審査手続きを行い、それでも認められなければ、裁判手続きをとることになります（いきなり訴訟を起こせる場合もあります）。
一番数が多く、種類も多いのが、民事事件です。
金銭貸借、契約違反、相続、離婚、売買など、いずれも民事事件です。
その中でも、夫婦間の事件、親子を巡る事件、相続事件などは家事・人事事件と呼ばれ、家庭裁判所が事件を取り扱います。」（引用終わり）
