【PDCA日記 Vol. 1,263「示談でお金を払うとは限らない」】
私は一時期通信制で法律を学んでいたこともあり、PDCA日記でも法律関係の書籍を紹介することが時々あります。
自営を始めると、裁判所絡みの手続きに遭遇することがあります。
裁判所は法律やルールを守っている人の見方であり、司法手続きを恐れる必要はありません。
日本の場合、裁判所経由のプロセスを避ける傾向にありますが、司法を通さずにやり取りをしていると、逆に物事が決まらないケースもあります。
トラブルに巻き込まれた場合、まずは専門家に相談の上、司法手続きを取るべきかどうか判断することがポイントになってきますね。
今回紹介する資料「おとめ六法」は「女性の人生に寄り添う法律の本」をキャッチフレーズにしており、「示談=お金を払うとはかぎらない」部分の以下フレーズが印象的でした。
「『示談が成立した』というと、加害者はお金を払い、被害者はお金を受け取った、と思われがちですが、必ずしもそうではありません。
損害が生じているときには、たしかにお金での補償をすることが多いですが、当事者どうしの意見が一致すれば、お金のやりとりはなく、『今後一切連絡を取らない』などの条件をつけて解決することもあります。
ここで重要なのは、お互いが『それでいい』と合意することです。」（引用終わり）

P.S. 裁判沙汰になるケースでは、相手との信頼が崩壊していることがほとんどです。
「今日、僕の家にロボットが来た」という本によると、「信頼性」の定義は「機械が予測どおり行動してくれる『確からしさ』が高い」であるそうです。
ビジネスを通じて色々な裁判沙汰を経験してきた者として、人間に対する「信頼」も「信頼性」に近いように考えています。
「信頼性」の定義である「相手が予測どおり行動してくれる『確からしさ』が高い」ことを人間に当てはめると、「約束を守る可能性が高い」と言い換えられるでしょう。
私にとって、「約束を守る可能性が高い人」は、シンプルに「時間を守る人」ですね😊。
「時間を守れない」イコール「約束を守れない」イコール「契約を守れない」イコール「裁判沙汰になる」ことを知っておくことは、ビジネスパーソンにとって非常に重要でしょう。
「飛躍しすぎ」と思われたかもしれませんが、自営を始めると裁判所は非常に身近な存在になります。
裁判沙汰になるケースの大部分は、時間を守れないことに起因すると私は考えています。
私が時間厳守にこだわっている最大の理由は、ここにあります。
取引先が期日通りに支払いをしない場合（これも時間を守らない一種）、自営業者は内容証明などの裁判外手続きを取るか、支払督促などの裁判手続きを取るかの判断をしなければなりません。

＜ Mr. PDCAのボンジュール英語「示談」 = 「settlement」＞
今回出てきた「示談」の英訳は、「settlement」になります。
「示談でお金を払うとは限らない」を英語で表現する場合、「You don't always pay for a settlement」とすればよいですね😊。

Courts are the view of those who follow the law and rules, and you don't have to be afraid of judicial proceedings.
In the case of Japan, there is a tendency to avoid the process through the court in business.
However, there are cases where things are not decided when communicating without going through the judiciary.
If you get into trouble in business, the point is to first consult with an expert and decide whether or not to take judicial proceedings, I suppose.
