最近はアメリカ大統領と州知事のやり取りがメディアで取り上げられていますが、アメリカの州には日本の都道府県にないものが結構あったりします。
まず、アメリカには州兵がいます。
州兵は通常時、州知事の指揮の下、治安維持や災害対策を行っています。
一方、戦時中になると、州兵は大統領（連邦政府）の指揮下に入る仕組みになっています。
ただ、州兵は英語で「National Guard」と言います。
「National Guard」を直訳すると「国家警備隊」になるため、なぜ「州兵」になるのか詳しい方は教えてください :-)。
今回紹介する資料「基礎から学べるアメリカ法」はアメリカ法を分かりやすく解説しており、「州の憲法」部分の以下フレーズが印象的でした。
「各州も州憲法を有しており、各州の統治機構を整備するとともに、人権保障も提供されている。
この効力は連邦法に劣後し、よって連邦憲法に違反することはできないから、連邦憲法上の人権保障は最低限を画することになる。
しかし、それより手厚い保障を州憲法が提供する分には差し支えない。
また、連邦憲法は主として自由権を保障し社会権的な権利は全く規定されていないが、州によっては教育を受ける権利などを憲法上規定しているところもある。
どの程度、連邦憲法レベルよりも手厚い権利保障を提供するかは州によるが、州レベルでの動向が連邦レベルの動きの先駆けになることも時折見られる。」（引用終わり）

P.S. 日本の場合、2000年に施行された地方分権一括法によって、国と都道府県の立場は対等になりました。
以前、大臣がある県の知事を訪問した際、応接室で知事が待っていなかったことに大臣が激怒したことがありました。
この件をメディアが取り上げたことから大臣はすぐに辞任し、2012年の総選挙で敗北して政界を引退することになりました。
この時に県知事は、「国と都道府県は対等であり、上下関係にはない」とコメントしていましたが、地方分権一括法のことを指していたものと思われます。
横柄な態度を取っていると、どの世界でもはじき出されることは同じようですね :-)。
＜Mr. PDCAのボンジュール英語「憲法」=「constitution」＞
今回出てきた「憲法」の英訳は、「constitution」になります。
「アメリカには州の憲法がある」を英語にする場合、「US has State Constitutions」とすればよいですね :-)。

"Each state has its own state constitution, and each state has its own governance system and human rights guarantees are provided.
This effect is subordinate to federal law and, therefore, the state constitution cannot violate the federal constitution.
However, it does not matter as long as the state constitution provides more generous protection.
In addition, although the Federal Constitution mainly guarantees free rights and does not define social rights at all, some states provide the right to receive education in the state constitution.
The extent to which it offers more protection than the federal constitutional level depends on the state, but state-level developments can occasionally pioneer federal movements." (Unquote)
