今回紹介する資料「作動する法/社会―パラドクスからの展開」は、「根源的なパラドクスを抱えた法システムが作動する時、社会、人、そして法はどう変わるのか」を解説しており、「ジェンダーとしての無毛規範」部分の以下のフレーズが印象的でした。
「むろんだが、女性は、一定の年齢になると、自然に体毛処理をはじめるように生まれついているわけではけっしてない。
処理することが女性一般の体質に合っているからでもまったくない（それどころか逆に、剃毛【ていもう】や脱毛のせいで、肌が荒れたり黒ずんだりするトラブルに悩まされる女性も少なくない。
また、古今東西のあらゆる社会（共同体）において、女性の体毛除去が決まり事とされてきたわけでもない。
それにもかかわらず、体毛除去は、社会から”女らしい"と認められるための作業として当然視されているため、その作業を怠ると”女らしさ"を欠いているとみられてしまうのである（Toerien et al. 2005, p.399, p.405）。
これはジェンダーにほかならない。
ジェンダー（gender）とは、女だから / 男だからこうするべきだ（あるいは、するべきでない）というように、性別を理由として、人の生き方や振る舞いに何らかの型枠（かたわく）をはめようとする意識や慣習、制度をいう。
女性は、毛の生えていないつるつるの肌であるべきだ（そのために剃ったり抜いたりして”むだ毛”を除去すべきだ）というのは、まさにジェンダーそのものである（Tondeur 2008, p.80）。
ジェンダー規範は、あたかも、もともとそうだと決まっているかのように、また、それ以外のありかたなど考えられないかのように見えることもある。
しかし実のところは、各時代・各社会の支配的な価値観によって作られた約束事に過ぎない。
つまり、ジェンダーとは、社会的構築物である。
これがジェンダーを関上げるときの要諦（ようてい）となる。
構築物とは作られたものであり、そうであるからには、作り変えられるということが含意されている。
ところが、そうした作り変えや、その前提として、そもそもそれが作られたものだと気づくことさえ、なかなかたやすいことではない。」（引用終わり）

P.S. 今回紹介する資料「作動する法/社会―パラドクスからの展開」が述べている「支配的な価値観の約束事」という考え方は、色々な意味で興味深かったですね。
私は冠婚葬祭の時以外にネクタイをすることはありませんが、ネクタイ自体が江戸時代のちょんまげと同じであり、「支配的な価値観の約束事」の典型と言えるでしょう。
「支配的な価値観の約束事」とは、「みんながそうしているから自分もそうすべきという考え方」と言い換えられるかもしれません。
「大学を卒業したら就職すべき」という意識も、「支配的な価値観の約束事」の一つであるように私には見えますね。
ただ、最近は「支配的な価値観の約束事」から逸脱する人も出てきています（私もその一人かもしれませんね😊）。
男性として生きていると、女性と食事に行った時は「男性が支払うべき」という暗黙のルールがあるような気がします。
これも「支配的な価値観の約束事」かもしれませんが、様々な考え方があるため、ご意見がある方は是非コメントください😊。
＜ Mr. PDCAのボンジュール英語「支配的な」 = 「dominant」＞
今回出てきた「支配的な」の英訳は、「dominant」になります。
「支配的な価値観の約束事」を英語で表現する場合、「Promise of dominant values」とすればよいですね😊。
The material introduced today "Working Law / Society-Development from Paradox" explains "How society, people, and law change when a legal system with a fundamental paradox works and as a gender" and the following phrases in the "Hairless Norm" part were impressive.
"Of course, women are never born to start hair treatment naturally at a certain age.
There is no treatment at all because it suits the general constitution of women (on the contrary, many women suffer from problems such as rough skin and darkening due to shaving and hair loss).
Nor has it been a rule for women to remove hair in all societies (communities) of all ages.
Nonetheless, hair removal is taken for granted by society as a task to be recognized as 'feminine,' and neglecting that task can be seen as lacking 'femininity' (Toerien et. al. 2005, p.399, p.405).
This is nothing but gender.
Gender is a woman / a man, so you should (or shouldn't) do this because of your gender. Awareness, customs, and systems to do.
It is gender itself that women should have smooth, hairless skin (and therefore shave and pluck to remove 'waste hair') (Tondeur 2008, p.80).
Gender norms can appear as if they were originally determined to be, or otherwise unthinkable.
However, in reality, it is nothing more than a promise made by the dominant values of each era and each society.
In other words, gender is a social structure.
This is the key to raising gender.
A construct is made, and because of that, it implies that it can be remade.
However, it is not easy to make such a change, or even to realize that it was made in the first place as a premise." (Unquote)
